Co-Chair Dottie Dolan called Meeting to order at 4:00 pm.
Beach monitoring scheduled for Sat at 9:00 am. Dottie and Paul will go with Lonni.
Jurisdictional Opinion:
Bernadette McLeod, 46 Springbrook Road, remove large pine tree. Ginie Page moved to approve the JO; seconded by Ed Reynolds; passed 6-0
Frank Corbin represented Dr. Susan Connors, 30 Catboat Road, remove trees and replace with native plants and erect a shed on concrete blocks. Ed Reynolds moved to approve the JO; seconded by Ginie Page; passed 6-0.
Agents Report:
Agent Greenberg reported she wrote an Enforcement Order for siltation barrier violations and violations of the Order of Conditions for Norma McDonald. Fines will go into effect on a daily basis.
Mark Burgess asked the Commission for advice regarding a section of coastal bank between the Kandell and Pearson property. The bank is not in good condition now. The Kandells own the beach and the bank. The Town owns property behind it; however, there is no structure on the property. Mrs. Kandell would like to extend her revetment. It would take approximately 500 yards of material to renourish the bank. Burgess recommends extending the revetment and use fiber rolls, the same as Pearsons have on their property. The Commissioners discussed the feasibility of closing the gap between revetments. Agent Greenberg suggested leaving a 30 foot opening to get better compliance for renourishment from the home owners. There is a potential to endanger the dwellings and
revetments if nothing is done in the future. Burgess suggests asking permission from the Town to use the Town property as an access to deposit the sand. Agent Greenberg recommends submitting an amendment for the Kandell Order of Conditions. She will write a letter to Mark. The Commissioners will make a site visit on November 1.

Due to the lack of receipt of DEP numbers and responses from Natural Heritage, many cases cannot be finalized at the hearings. Agent Greenberg stated we still need to give applicants the option to discuss the project.
Discussion took place about pesticides, particularly for phragmites. Flyers and brochures are available to the public as well as posters. Agent Greenberg will have these available at the Special Town Meeting. She also suggested a letter be written to the Board of Health identifying those pesticides and fertilizers that affect drinking water. Andrew Petty also suggested identifying politicians who are environmentally involved.
The contractor and neighbors have been in contact with Agent Greenberg regarding the house that is falling into the ocean. The neighbors are willing to help remove house.
DEP will be opening an office on the Cape. A representative is willing to come to one of our meetings.
Discussion took place regarding the Gilmore property and Danforth property. The Commissioners would like to review the meeting minutes. Gilmore’s Order of Conditions expires 2007.
Agent Greenberg reported she is in contact with people working on the Mayo Creek restoration. A grant is being written to introduce salt water into the area.
Public Hearings:
Olive, 113 4th St., Map 40, Parcel 118: Request for Certificate of Compliance. A site visit was made, no chink stones were visible and Agent Greenberg feels the project is in compliance. Paul Banner moved to issue a Certificate of Compliance; seconded by Ginie Page; passed 6-0.
Town of placeCityWellfleet, RDA, Commercial St., Repair Culvert. Kevin McHugh of Environmental Partners Group represented the Town. He stated the road is settling because the culvert joints are separating which allows sand and dirt to settle. They want to line the culvert using pvc. There will be no excavation in the wetlands. The project should be completed within 2 hours. The life expectancy of the culvert is 20 years. Ed Reynolds identified this as a Negative 2; seconded by Paul Banner; passed 6-0.
Lindberg, RDA, a5 Catboat Rd., Map 41, Parcel 80, Septic Upgrade. Paul Lindberg represented the applicant. Ed Reynolds moved to identify the project as a Negative 3; seconded by Ginie Page; passed 6-0.
Purcell, RDA, 30 Higgins Lane, Map 15, Parcel 119, replace deck. George Moe represented the applicant. The proposed project is to remove and replace the existing sundeck behind the cottage. Discussion took place to add the replacement of stairs due to safety issues. The Commission agreed to add the stairway to the RDA. Ginie Page moved to identify the project as a Negative 3; seconded by Paul Banner; passed 6-0. Dottie Dolan will supervise.
Kostyk, RDA, 71 Catboat Rd., Map 41, Parcel 106, construct screened porch. Chet Lay represented the applicant. The screened porch will be on the existing deck and the staircase will be relocated with a new concrete pad. The deck will be rebuilt using the existing footings. Paul Banner identified the project as a Negative 3; seconded by Ginie Page; passed 6-0.
Fowler, RDA, 11 Pine Point Way, Map 21, Parcel 47, construct garage. Agent Greenberg was informed Fowler consulted with her site surveyor and the proposed garage is out of the buffer zone. The applicant withdrew her application.
Elliott / Klink, 3 B Indian Neck, Map 28, Parcel 231, Amended Order of Conditions. Per a request of the applicant to continue, Ginie Page moved to continue to November 1, 2006; seconded by Paul Banner; passed 6-0.
Baptist, NOI, 461 State Hwy, Map 42, Parcel 130, Create additional pervious parking area (Cont’d from 10/04/06). Per the applicant’s request for a continuation, Ginie Page moved to continue to November 1, 2006; seconded by Ed Reynolds; passed 6-0.
Goldman, NOI, 266 King Phillip Rd, Map 34, Parcel 8, remodel existing dwelling adding new decking and larger living room (Cont’d from 10/04/06). Gordon Peabody and Joy Cummings represented the applicant. The Natural Heritage letter has not been received and Gordon requested conditions be set after the receipt of the letter should there be any endangered species. The Board agreed no decision could be made until they received the letter. Paul Banner moved to continue the hearing upon the response from Natural Heritage; seconded by Ed Reynolds; passed 6-0.
O’Connor, NOI, 90 Le Count Hollow Road, Map 30, Parcel 9, septic upgrade and landscaping (Cont’d from 10/04/06). Emily Beebe, representing the applicant, requested a continuation. Ginie Page moved to continue to November 1, 2006; seconded by Paul Banner; passed 6-0.
Footit, NOI, 10 Bay View Ave, Map 35, Parcel 33, renourishment of coastal beach and bank (Cont’d from 10/04/06). David Little represented the applicant. Approximate mean high water has been identified by a photograph. An easement agreement is being worked out with the Conservation Trust. Ginie Page recused herself. Agent Greenberg stated the Conservation Trust was in favor of this project. Ed Reynolds moved to approve Plan 99917 dated 9/12/06; seconded by Paul Banner; passed 5-0.
Blake, NOI, 461 449 Long Pond Rd, Map 16, Parcel 616, construct addition to dwelling. Chet Lay represented the application. The closest work area is 85 feet from the wetlands. The project was discussed at a previous meeting. Ginie Page moved to approve plan 2006-103 dated August 23, 2006 and revised on 10/04/06; seconded by Paul Banner; passed 6-0.
Bessette, 2685 State Hwy, Map 15, Parcel 127, 129, & 130, install paving (Mobil Station). Gerry Bessette explained the proposed project. The back will require grading to level off the land and install a pervious driveway for a coffee and donut operation. The drive will go around the building. The trailer in the back will be removed. He stated the ZBA has approved the project. Agent Greenberg stated storm water issues need to be addressed. Ed Reynolds moved to continue to 11/01/06; seconded by Lonni Briggs; passed 6-0.
Miller, 246 King Phillip Rd, Map 34, Parcel 12, septic upgrade. The applicant requested a continuation. Ginie Page moved to continue to 11/01/06; seconded by Ed Reynolds; passed 6-0.
